1. Eligibility and Business Use

You must be at least 16 years old to use NearSolid. The Service is intended primarily for professional and business use. By using the Service, you confirm that you meet these requirements.

2. Account and Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials secure.
• Be responsible for all activity under your account.

For Team plans, the account administrator is responsible for managing user access and ensuring compliance with these Terms by all team members.

We may suspend or terminate accounts that violate these Terms.

3. Description of the Service

NearSolid allows users to process vector-based design files (e.g., SVG) and generate 3D previews with configurable materials. The platform offers tools to visualize, present, and prepare designs for fabrication processes such as laser cutting, CNC, and related applications.

Important: At this time, user design processing is handled locally in the browser. If server-side processing or file uploads are enabled in the future, these Terms will be updated accordingly.

Certain features, including AR visualization, depend on device compatibility and technical limitations.

4. Subscriptions, Billing and Payments

We offer recurring monthly and annual subscription plans. Payments may be processed directly by NearSolid or via our billing partner (e.g., Lemonsqueezy).

• Monthly plans are billed on a recurring monthly basis and may be canceled at any time. Cancellation affects future billing periods only.
• Annual plans are billed upfront for a full 12-month period.
• Unless otherwise stated, subscriptions renew automatically at the end of each billing period.
• Cancellation prevents future renewals but does not entitle you to a refund for unused time in the current billing period.

All payments are non-refundable except where required by applicable law.

Prices are listed in euros (EUR) unless otherwise specified and may be subject to change with prior notice.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful or harmful purposes.
• Upload or process content that infringes third-party rights.
• Attempt to reverse engineer, disrupt, or interfere with the Service.

6. Intellectual Property

NearSolid retains all rights in the platform, software, and related content (excluding your own designs). You retain ownership of your designs and content.

7. Third-Party Services

NearSolid may use third-party services such as authentication or payment providers. Their respective terms and privacy policies apply.

8. Termination

You may cancel your subscription at any time. We may suspend or terminate access if you breach these Terms. Upon termination, your right to use the Service ends immediately.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, NearSolid shall not be liable for indirect, incidental, or consequential damages.

Our total liability for any claim arising from or related to the Service shall not exceed the total amount paid by you during the twelve (12) months preceding the event giving rise to the claim.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising from these Terms or the use of the Service shall be subject to the jurisdiction of the courts of Spain.

12. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

1. Ámbito y uso profesional

NearSolid es un servicio dirigido principalmente a profesionales y empresas. Al utilizar el Servicio, confirmas que tienes al menos 16 años y capacidad legal suficiente para contratar.

2. Cuenta de usuario

Para acceder a determinadas funcionalidades es necesario crear una cuenta. El usuario se compromete a:

• Facilitar información veraz y actualizada.
• Mantener la confidencialidad de sus credenciales.
• Asumir la responsabilidad de toda la actividad realizada desde su cuenta.

En los planes Team, el administrador del equipo será responsable de la gestión de accesos y del cumplimiento de estos términos por parte de los miembros del equipo.

3. Descripción del servicio

NearSolid permite procesar archivos de diseño vectorial (por ejemplo, SVG) para generar previsualizaciones 3D y visualizaciones en AR.

Actualmente, el procesamiento se realiza de forma local en el navegador del usuario. Determinadas funcionalidades pueden depender de la compatibilidad del dispositivo.

4. Suscripciones y pagos

NearSolid ofrece planes mensuales y anuales.

• Los planes mensuales se facturan de forma recurrente y pueden cancelarse en cualquier momento, con efecto en el siguiente periodo de facturación.
• Los planes anuales se facturan por adelantado por un periodo completo de 12 meses.
• Salvo indicación en contrario, las suscripciones se renuevan automáticamente.
• La cancelación impide futuras renovaciones, pero no da derecho a la devolución proporcional del periodo ya contratado.

Los pagos no son reembolsables salvo en los casos exigidos por la legislación aplicable.

5. Responsabilidad

NearSolid se ofrece “tal cual”, sin garantías de disponibilidad ininterrumpida.

La responsabilidad total de NearSolid por cualquier reclamación no excederá del importe abonado por el usuario en los doce (12) meses anteriores al hecho que origine la reclamación.

6. Legislación aplicable

Estos términos se rigen por la legislación española. Para cualquier controversia, las partes se someten a los juzgados y tribunales competentes en España.
